This could be an interesting development.
Studios who rush to market without testing (not saying Bungie did this, but generally speaking) liable for damages.

It’s software, of course it can crash, the terms of use indemnifies bungie / Microsoft.
God the guy in this story gets on my nerves. Seeking damages?…. What a tosser press the fecken reset button and shut up. If it’s a serious issue a patch will come out, otherwise bring it back / sell it and your out maybe a tenner and learn to not buy anything on the first day if you want zero teething problems. They didn’t set out to introduce bugs and went to great lengths to beta test the whole thing.
Class actions were meant to be used for decent causes Erin Brockovich style not petty grumblings from some American teen.

This will go precisely nowhere. There is no proof that the xbox360 wasn’t previously damaged, faulty, mistreated or in an unsuitable environment. How can anyone be certain that the fault lies with the game? oh add that to the fact that microsoft/bungie’s lawyers will bury this in about 30 seconds flat if they ever even make it to a court room. Thats before we even touch the terms of use.
A waste of time.

I’m sure there is plenty of "head-line-grabbing" lawyers in the U.S., coupled with game-hating-senators who will throw some money/support in this guys direction.
But on a different note, I can’t ever remember a console game crashing/stalling or anything else? Am I just extremely lucky? Its mostly why I don’t bother with PC games anymore, as they crash, require patch(es), etc.
How many times (if at all) has your console crashed?

I have an xbox360 that "red lighted" about 3 days after it was bought, it was one of the dodgy launch ones with the faulty power supplies

I bought a new 360 last week and it red ringed right out of the box. Brought it back and the second one red ringed right out of the box. Went back in again, and confirmed a working one in the shop.
That said those 2 machiens were used more this year than both my Wii and PS3 (Although I have Mario Galaxy now).
I don’t believe the issues were actually with the Consoles themselves but rather the handling of them as I would imagine in the run up to christmas and the rush to get stock out there they were mishandled somewhat. (both boxes should a little sign of abuse)
Oh and the guy above is an idiot.
