Nice article, I think ‘yes’ is the short answer. Ian Bogost’s ‘Things To Do With Videogames’ has some good discussion defining different categories of ‘art’ games, well worth reading.

IP rights in games, media and art is a pet subject of mine, but it does not come up often enough in practice for me, truth be told.
Interesting case here, and probably indicative of a trend in celebrities developing, monetising and exploiting their image and "look":
