hello all,
I was wondering about the legalities of creating video of a game, for commercial use. The video of the game would be used in a piece of software I have created. I am either going to use real life video footage or game video footage. It would be greate to use game video footage but I doubt that legally I could use it.regards

yeah the graphics in a game would be copyright protected. unless u used something like the editor for unreal or something and make you own model and textures etc, i think thats ok

reasonable personal usage probably kicks in at some point. Could you describe more exactly what you plan to do?

thanks for your replies… I will not be using the videos captured for personal usage.They will be part of a software application that I have created, it will ready to sell in under a month. The video in the application is a head cam recording of a cyle through a small town. It would be better if I recorded a fly through/walkthrough of a game environment, but I have very little design skills so creating an interesting 3d world ( for instance a small-ish village) is beyond me.

I’m an IT lawyer, so I’d like to help, but I find your post a little confusing. If you are saying that you want to video someone else’s game and to incorporate it into something that you intend to licence yourself then you can’t do that without their permission – which will (if they have any sense) have some conditions attached. Is that your question answered?

Thank you deek that is my question. I thought that would be the answer. Is there any of you guys involved in a games company that would like to license your content of the above purpose. I want to create a video of a walkthrough/flythrough of a detailed 3D environment. Its not necessarily a video of some one playing the game but could be a video of a flythrough using the games 3D editor.

What is it that your software does and how would the video be used? I have clients who might well be interested but it depends what is being done with the video.
